REFUNDS & CANCELLATIONS
- All online bookings require pre-payment.
- In the event that a player or group of players cannot make a reserved tee time, and provided the golf shop staff are notified 48 hours prior to your tee time, a refund will be issued to the value of the booking – less the booking fee and less an administration fee of $7.50.
- For cancellations within 48 hours of your tee time, exceptional circumstances may be provided. Please contact the General Manager to discuss.
- Byron Bay Golf Club reserves the right to alter tee times without notice due to circumstances outside of Byron Bay Golf Clubs control. (E.g. lightning, slow play, course renovations).
TEE TIME MODIFICATIONS
- Bookings cannot be modified online. Modifications to tee times can be made by calling the Pro Shop on (02) 66856470 ext 1. No guarantee can be given for the requested date/time.
- You must check in at the Pro Shop a minimum of 20 minutes before your tee time is due to start, should you not arrive and register with the Pro Shop you may risk the cancellation of your tee time, in this event a credit note will not be given.
- Byron Bay Golf Club reserves the right to remove customers from the course if the rules of Byron Bay Golf Club have not been adhered to. These rules are consistent with the etiquette outlined by the R&A in the rules of golf and are monitored by golf operations staff. • All patrons utilising the Byron Bay Golf Club do so under the instruction of the golf operations staff. Failure to adhere to instructions may result in removal from the golf course.
GOLF CART ASSUMPTION OF RISK, WAIVER OF LIABILITY AND INDEMNITY
- Please read this document carefully.
By booking via the Byron Bay Golf Club MiClub page, you are, as the representative of the group, both personally and on behalf of the group, giving up substantial rights, including the right to sue Byron Bay Golf Club Ltd ABN 62001043205, its officers, employees, and agents.
RULES AND REGULATIONS
- All golf cart drivers must be over 18 years of age and MUST have a current driver’s license.
- Children are NOT allowed to drive golf carts at any time.
- Golf carts must not be operated in a manner that may endanger passengers or other people on the course, or damage property.
- No more than 2 persons and 2 golf bags are allowed in the golf cart at any one time.
- Persons are NOT permitted to ride on the back of a golf cart for any reason.
- Golf carts are NOT to be driven anywhere except as instructed and signed on the golf course fairways and on designated cart paths.
- On par 4s and par 5s, carts may be driven on fairways (if conditions allow) but must return to cart paths when within 20 meters of greens.
- On all par 3s carts MUST always remain on cart paths.
- All steep ground, bare areas and areas affected by water must be avoided.
- All golf cart drivers must not be intoxicated (whether by drugs or alcohol) whilst in control of the golf cart.
DAMAGE TO GOLF CART
- I agree to return the golf cart immediately following completion of use, in as good condition as I received it, normal wear and tear excepted. I agree to pay for any damage or loss (including any legal costs incurred by Byron Bay Golf Club) to the golf cart whilst the golf cart is in my possession and control.
WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
- Waiver of Liability: In consideration of being permitted to use Byron Bay Golf Clubs golf cart, to the extent permitted by law, I hereby waive, release, covenant not to sue and discharge Byron Bay Golf Club, its officers, employees and agents from any and all claims, actions, suits, demands, losses and other liabilities of any kind resulting from the inherent risks of using the golf cart or the negligence of Byron Bay Golf Club that I may have arising from use of the golf cart. This applies to personal injury (including death) from incidents arise from the use of the golf cart and any and all claims resulting from damage to, loss of, or theft of property.
- Assumption of Inherent Risk: Use and control of a golf cart, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, from one location to another, from one individual to another, but the risks of driving, riding or using a golf cart range from minor injuries to major and catastrophic injuries including paralysis and death. I understand and agree that it is my responsibility to assess the hazards presented by my use of the golf cart and further agree that I am the ultimate judge as to whether I can use the golf cart without risk of harm to myself and others.
- Indemnification Agreement: To the extent permitted by law, I agree to DEFEND, INDEMNIFY AND HOLD HARMLESS Byron Bay Golf Club, its officers, employees and agents, from and against any and all claims, demands, actions or causes of actions, for costs, legal fees, expenses or damages to personal property, or personal injury, or death, which may result from any use of the golf cart. This applies both to claims arising from the inherent risks of using the golf cart or the negligence of Byron Bay Golf Club, its officers, employees, and agents.
FURTHERMORE, I WARRANT THAT I AM FAMILIAR WITH THE OPERATION, USE AND CONTROL OF THE GOLF CART, THAT I HAVE READ THE RULES ABOVE AND THAT I AM ABLE TO OPERATE THE GOLF CART SAFELY AND IN ACCORDANCE WITH THE RULES. GUIDELINES FOR PLAY
- Markers indicate distances to the centre of the green on par 4’s and 5’s at 100 (Red plate), 150 (white plate) and in some cases 200 (blue plate).
- Red flags indicate pin placement on the front third of the green, yellow flags indicate middle third, and Blue and white cheque flags indicate the back third.
- Golfers must give way to ground staff at all times.
- The course Marshall controls pace of play and direction must be taken from him/her.
- Management reserves the right to remove persons inappropriately behaved or attired from the course. Note there is NO BYO on course – all beverages must be bought via the Clubhouse – if found with BYO this will result in forfeiting your round of golf.
- Should your group be unable to keep up with the group ahead and you are delaying the progress of the following group they should be called to play through.
- Maximum of 4 players to a group. Each player must have their own equipment. There is no sharing of equipment. All players must carry a sand bucket and replace divots.
